Accident in a WalMart parking lot and the other party's insurance denied my claim... any advice?

Hi everyone, I would appreciate your ideas regarding the following situation: My son had a car accident last week in a nearby WalMart parking lot (Dallas, Paulding County, GA). He was driving down a parking lane and hit a car which came out of nowhere cutting across the aisle. Both vehicles had extensive damage (front of the vehicle on our car, and driver side on the other car). There was a gentleman who saw everything and called 911. The sheriff's deputy arrived at the scene promptly. He explained there would be an accident report, but since this happened in a private parking lot, he was not in a position to state who was at fault. I got the report the other day and it states the facts about the accident and gives the contact information for the witness. I have spoken with the other driver's insurance company three times and I just found out that their claims rep has determined that my son was at fault, so they have denied my claim. The claim with them was actually originally filed by the other driver. I politely asked to speak with a supervisor and was advised that I should expect to receive a call from a supervisor soon. I did not get a chance to talk to my insurance rep after I found out the other insurance denied the claim, but I am not sure if there is anything my insurance can do for us, especially given the fact that we only have liablity coverage on this vehicle (no collision coverage either). I think it is really outrageous how they could claim my son was at fault, if all evidence points to the fact that their insured was driving across the parking lanes and obviously did not see our car. I cannot find anything online (like traffic regulations) that explicitly says that the driver cutting across the parking lanes is at fault if there is a collision, but I think it is common sense that this should be the responsible party! If anyone has had a similar experience, or has any suggestions, your help will be very much appreciated!

Hello, I would really appreciate any one who can help me out with this, personally i am so disgusted with the government and the way the country is run that i don't know much about politics as i stay away from it for my own stress levels. Two months ago my nephew took his own life, as well as a variety of mental health problems (Which of course also go's uncared for in this country) other reasons he couldn't cope to live in society was that he couldn't get a job (200+ job application attempts) he discovered that to increase his chance of getting a job he would learn to drive so he can get to A to B. After going into approx. 90% of his life savings he managed to take driving lessons and even managed to pass his test. At this point he couldn't get insured because he discovered even if he was in a FULL TIME job he couldn't afford it. Yes he was male and was an adolescent. But he didn't want to drive to show off , have a nice car . Etc. he wanted a car to get to A to B to increase the chances of getting a job. I want to know who is in charge of car insurance etc. (department of transport??) so i can write to them and explain the situation which makes me sick to my stomach thinking about. Everyones aware the government are trying to get young drivers off the road, but to then expect them to find a job even in this tough climate is beyond me. My car is totalled and the at fault insurance company won't pay. What do I do?

I was recently rear ended. The lady who hit me was not the owner of the car. The car is insured with Access General under the boyfriends name. Access General came to assess my car and deemed it totalled. They gave me a dollar amount of how much the car is worth and what they are willing to pay for it. Heres the problem, Access General is claiming that they can not get a hold of the boyfriend and that they can not process anything and will close the file if they do not make contact with him. So basically, I would be stuck. Obviously, I am going to get a lawyer, but has anyone ever heard of such a thing? Am I missing something here?

I was found at fault for two accidents (damage >$750) a couple years ago and also got ticketed for turning right on a red at a no right on red light. I just spoke with my car insurance company and was told that the accidents will remain on my record for 5 years. Is that true? I looked up the DMV code for California and it looks like the accidents are reportable for only 3 years (no one was hurt, no felony or criminal charges - these were small fender benders). Is the reporting time really 5 years?
